Registration Terms and Conditions

1.Your acceptance of these Terms

1.1. By registering on your own behalf or on behalf of others, you have read, understood and agree to be bound by these Terms and the terms and conditions of our privacy policy which are published on this website and incorporated in these Terms by reference.

1.2. CIPR reserves the right to change, modify, add or delete parts of these Terms at any time and without further notice. Such amendments shall be effective upon posting the revised Terms on the website.

1.3. These Terms are binding on registrants.

2. Access and Use of this Website

2.1. CIPR hereby grants you permission to use the UKLR website to register in accordance with these Terms, provided that (a) you meet the definition of lobbyist below:

“lobbying services” means activities which are carried out in the course of a business for the purpose of—
(a) influencing government, or
(b) advising others how to influence government.

2.2. By registering, you agree that the following will apply to you or your organisation:

(a) Where a complaint is received about a CIPR member, the CIPR will administer it in accordance with its regulations and the usual sanctions will apply where a breach of the code can be proved. (b) Where a complaint is received about a registered individual or organisation accountable to a recognised code of conduct (e.g. the APPC), the complaint will be passed to that organisation for action and their sanctions will apply where a breach of a code of conduct can be proved. (c) Where a complaint is received about a registered individual or organisation which is not accountable through their member of either the CIPR or an organisation with a recognised code of conduct, all other things being equal, the CIPR code of conduct and regulations will apply. (d) Expulsion from membership (either from the CIPR or from an organisation with a recognised code of conduct) will result in the individual or organisation being struck from the UK Lobbying Register. (e) Where a registered individual or organisation is not a member of the CIPR or an organisation with a recognised code of conduct, should a breach of the CIPR code of conduct be proved and sufficient to merit expulsion, that individual or organisation will be struck from the UK Lobbying Register. (f) Where a registered individual or organisation is struck from the register, the relevant names will be published on the UKLR website. (g) The CIPR reserves the right to strike from the UK Lobbying Register, any individual or organisation where, in its own judgement, a sufficient breach of professional standards can be proved

3. Registration and security

3.1. To be entered on the UKLR register, you will need to provide certain information as requested during the registration process.

3.2. CIPR reserves the right to refuse to admit to the UKLR any applicant at any time. This will include any applicant who cannot provide evidence of basic business bona fides on request, or evidence of good standing within the lobbying community (evidence requested may include client testimonials or other current professional or trade body memberships, or audited accounts covering a reasonable period of trading of not less than 1 year.) CIPR may ask an applicant to defer registration until they can satisfy CIPR requirements.

3.3. If you are making an individual entry you are solely responsible and liable for any activity occurring on your entry. Whether you are an individual or authorised to act for a corporate entity, you must keep your account password secret. You must inform UKLR of any breach of security or unauthorised use of your account. CIPR will investigate any security breaches and we have the right to suspend or terminate an entry immediately. CIPR will not be liable for any losses caused by the unauthorised use of your account, but you may be liable for our or other users’ costs or losses caused by such unauthorised use.

4. Exemptions

4.1. Where entering any information may expose an individual, an organisation, its officers, directors, employees, contractors, partners or agents to harm, CIPR will at our discretion exempt such information from being placed on the register but will hold securely any such information.

5. Your obligations

5.1. You agree not to use the register for any illegal purposes and agree to use it in accordance with all relevant laws.

5.2. You agree not to enter any information into the register which will interfere with, interrupt or disrupt the normal operating procedures of a computer. This includes but is not limited to computer viruses, macro viruses, Trojan horses, worms, or links to external sites that might contain such entities.

5.3. You will not enter any material into the register which is unlawful, obscene, defamatory, libellous, threatening, harassing, racially offensive or encourages conduct that would be considered a criminal offence or give rise to civil liability, or is otherwise inappropriate.

5.4. You will not use the register in a manner that may cause the register or the website to be interrupted, damaged, rendered less efficient or such that the effectiveness or functionality of the register or website is any way impaired.

5.5. You will not use the register in any manner which violates or infringes the rights of any person, firm or company (including, but not limited to, intellectual property rights, confidentiality rights and privacy rights).

5.6. You agree that in the event that you have any right, claim or action against any registrant arising out of the registrant’s use of the register or website, you will pursue such right, claim or action, including legal action, independently of, and without recourse to CIPR, except that you will notify CIPR of any abuse of the register or website which gives rise to your right, claim or action.

5.7. Only data required for registration will be published. Any comments or opinions will be removed by CIPR.

5.8 You agree to maintain the accuracy of your information on the register and update your register entry within two months of any changes to your business that should be reflected in the register to keep it current and up to date.

6. Data retention

6.1. You acknowledge that you are responsible for ensuring your or your organisation’s entry is checked, is brought up to date and is in every respect factually correct.

6.2 You agree that all information provided in your register entry will be archived and retained for 5 years in accordance with our privacy policy (see below) and may be available to third parties either through interrogation of the register via the website, or upon request to CIPR.

7. Third Party Links

7.1. Links to third party websites are provided through the register and the website. You hereby agree that CIPR is not responsible or liable for the availability of such external websites or resources and acknowledge that CIPR does not endorse and is not responsible or liable for the practices and contents (including defamatory, libellous and infringing content) in any of the third party websites or resources, including (without limitation) any advertising, products or other materials or services on or available from such websites or resources, nor for any damage, loss or offence caused or alleged to be caused by, or in connection with the use of or reliance on any such content, goods or services available on such websites and resources.

8. Rights in the Register Entries

8.1. CIPR does not claim any proprietary rights in the entry that you register. You or your organisation retain all proprietary rights in your entry and will be solely responsible for the consequences of your entry.

9. Notification of Abuse Procedures

9.1. CIPR has in place a procedure by which registrants and users of the website may provide notification of any abuse and non-compliance with the Terms. If you see a register entry that is incorrect or offensive, you are requested to notify us by emailing: secretary@lobbying-register.uk.

9.2. CIPR will try to remove or delete any such entries as soon as practicable and may take any further action as deemed necessary.

10. Disclaimer and Limitation of Liability

10.1. CIPR is not responsible for and does not endorse any of the material entered on the register and we, our officers, directors, employees, contractors, partners and agents expressly disclaim any and all liability in connection with any such material.

10.2. CIPR does not permit infringement of intellectual property rights on the register, and we will remove any material if we are notified (using the relevant notification procedures) that it infringes another’s intellectual property rights.

10.3. CIPR reserves the right to remove any material without prior notice. We may also terminate any registrant’s account if the registrant breaches any of these Terms.

10.4. CIPR makes no warranties or representations, whether express or implied, as to the truth, accuracy, reliability, currency or completeness of the contents of the register and assumes no liability for any errors, omissions or inaccuracies in the register or for any loss or damage of any kind incurred as a result of any use made of the register.

10.5. CIPR will take reasonable measures to ensure the security of the CIPR website and of any information you provide us with, but we will not be liable to you for any damages resulting from any unauthorised access to or use of our secure servers and/or any and all personal information stored in them.

10.6. CIPR will have no liability in contract, tort (including, without limitation, negligence) or otherwise in connection with any part of these Terms or for any (a) economic loss, (b) loss of goodwill or reputation or (c) indirect or consequential loss arising out of these Terms, other than such as may not be limited or excluded under applicable law.

11. Indemnity

11.1 You agree to defend, indemnify and hold CIPR, its officers, directors, employees, contractors, partners and agents, harmless from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to legal expenses) arising out of or in connection with your registration, your use of and access to the register, any breach by you of the Terms and your violation of any third party right, including without limitation any copyright, intellectual property, or privacy right.

11.2. You agree that your obligation to indemnify us will continue even after this Agreement is terminated.

12. Data Protection

12.1. CIPR aims to comply with the applicable Data Protection legislation from time to time in place.

12.1. We will disclose your personal data if we are requested to do so by law or by any regulatory or governmental authority, or upon receipt of a court order or a legitimate request by a third party (for example, the police) in investigating illegal activities to provide information concerning your registration.

12.2. We reserve the right to notify or provide information to the relevant authority if we believe that you have carried out or are in the process of carrying out any illegal activity.

12.3. CIPR reserves the right to store any data submitted solely for our own internal purposes and we reserve the right to access, monitor and retrieve password protected information in order to fulfil our obligations, both legal and as established under these Terms.

13. Termination

13.1. CIPR may remove your registration immediately and without notice (without prejudice to our other rights and remedies). You may terminate your register entry with CIPR at any time by emailing secretary@lobbying-register.uk.

14. Severance of Terms

14.1.If any part of these Terms is found to be unenforceable as a matter of law, all other parts of these Terms shall not be affected and shall remain in force.

15. Law and Jurisdiction

15.1. These Terms (as amended from time to time) are exclusively governed by and construed in accordance with the laws of England and Wales whose courts will have exclusive jurisdiction in any dispute or any proceedings arising out of or in connection with these Terms, save that we have the right to commence and pursue proceedings in alternative jurisdictions.
